These terms of service (referred to below as "these terms") establish the terms of use of the service offered on this website (referred to below as "this service") by IMAGESTUDIO Noise (referred to below as "this studio"). A registered user (referred to below as a "user") shall use this service in accordance with these terms.

Article 1 (Applicability)

These terms shall apply to all relations concerning the use of this service between a user and this studio.

Article 2 (User Registration)

A person who wishes to register shall apply for user registration according to methods prescribed by this studio, and a user registration shall be deemed complete when this studio approves the application. This studio may disapprove the application for user registration and shall have no duty at all to disclose the reason if this studio determines that any of the following reasons exist pertaining to the applicant for user registration:

1. The applicant submitted false items when applying for user registration;
2. The application is from a person who has violated these terms; or
3. In addition, this studio has decided that user registration is not appropriate

Article 3 (Password Management)

A user shall manage their password for this service as their own responsibility. Whatever the case may be, a user may not transfer or lend their password to a third party. If a login is made after a password matches the registered information, this studio shall regard the use as being from the user themselves who has registered the user ID.

Article 4 (Usage Fee and Payment Method)

This studio shall separately determine the cost to use this service, and a user shall pay the usage fee shown on this website by a method specified by this studio.

Article 5 (Prohibited Acts)

Upon using this service, a user shall not engage in the following acts:

1. Violating a law or the public order and morals;
2. Engaging in an act related to a criminal act;
3. Disrupting or obstructing this studio's server or the network functions;
4. Engaging in an act that is likely to obstruct the administration of this studio's service;
5. Collecting or storing personal information, etc. related to other users;
6. Impersonating another user;
7. Providing benefits related to this studio's service directly or indirectly to criminal groups and individuals; or
8. In addition, engaging in an act that this studio decides is inappropriate.

Article 6 (Suspension, etc. in Providing this Service)

Without giving prior notice to a user, this studio shall be able to suspend or interrupt all or a part of providing this service if this studio determines that any of the reasons below exist:

1. A maintenance checkup of, or an update to, the computer system for this service will be performed;
2. It has become difficult to provide this service due to an act of God such as an earthquake, a lightning strike, a fire, a power outage, or a natural disaster;
3. The computer or communication line, etc. is interrupted due to an accident; or
4. In addition, this studio has decided that it is difficult to provide this service.

This studio shall not be liable at all for any loss or damage sustained by a user or third party due to a suspension or interruption in providing this service, regardless of the reason for the suspension or interruption.

Article 7 (Usage Restrictions and Cancellation of Registration)

Without giving prior notice, this studio shall be able to restrict all or a part of a user's use of this service or cancel a user's registration for any of the situations below:

1. The user violated any article of these terms;
2. It has become clear that the user's registration contains falsehoods; or
3. In addition, this studio has decided that the user's use of this service is not appropriate.

This studio shall not be liable at all for damages caused to the user due to an act performed by this studio based on this article.

Article 8 (Exemptions)

This studio shall be exempt from liability for its default on a debt unless the default is due to this studio's intent or gross negligence. Even if this studio is liable due to some reason, this studio shall only be liable for damages within a range of damages that could usually occur and within a range of the payment amounts for the paid service (for a continuous service, an amount equal to one month's worth of payment). This studio shall not be liable at all for transactions, communications, or disputes, etc. that arise between a user and another user or a third party relating to this service.

Article 9 (Changes, etc. to the Content of the Service)

This studio shall be able to change the content of this service or discontinue providing this service without notification to users and shall not be liable at all for any damages caused to users by these actions.

Article 10 (Changes to the Terms of Service)

If this studio deems it necessary, this studio shall be able to change these terms at any time without notifying users.

Article 11 (Notifications or Communications)

Notifications or communications between a user and this studio shall be done according to methods determined by this studio.

Article 12 (Prohibition on Transferring Rights and Duties)

Without the prior written consent of this studio, a user may not transfer or offer as collateral the rights or duties based on these terms or the user's status in the usage agreement.

Article 13 (Governing Law, Jurisdiction)

Japanese law shall be the governing law when construing these terms. If a dispute arises related to this service, the court that has jurisdiction over the location of this studio shall have exclusive and consensual jurisdiction.
